About these terms

These Terms of Use govern use of the website owned and operated by Sol Levinson & Bros., Inc. ("Sol Levinson," "we," "us" or "our"). Please read them before using website features or submitting content. If you do not agree to these terms, do not submit content or use features that require your agreement. Where we request express agreement, you must provide it before using the applicable feature.

Our Privacy Policy separately explains how website information is handled. These terms do not replace a funeral arrangement agreement, preplanning agreement or other agreement for services signed with us. A separate service agreement controls the services covered by that agreement.

Website information and assistance

The website provides obituaries, service information, memorial contributions, planning information and community resources. Information may be updated as families provide details or arrangements change. Please contact us to confirm time-sensitive service, location or event details rather than relying solely on an earlier email, saved page or external listing.

General educational content is not individualized legal, tax, financial, medical or mental-health advice. A website inquiry does not by itself reserve services, establish a price or create a funeral-services contract.

Ownership and permitted use

Sol Levinson & Bros., Inc. owns its original website design, custom code, branding and original content. Third-party software, fonts, photographs, trademarks and other materials remain subject to their owners' rights and applicable licenses. Contributors retain their rights in material they submit, subject to the limited permission described below.

You may view the public website and share links to its public pages. You may print or download reasonable portions of public information for personal, noncommercial remembrance, attending services or communicating service details with family and friends, without removing ownership notices or misrepresenting the source. This permission does not grant rights in another person's likeness or material beyond those we are authorized to grant.

Except as permitted by applicable law or a relevant license, do not reproduce our website as another service, republish its content commercially, use our branding to imply endorsement, or harvest memorial or contact information for marketing or resale without appropriate permission.

Submitting messages, photographs and other material

Submit only material you own or are authorized to provide for the intended use. You are responsible for obtaining permission from the people whose privacy, publicity or intellectual-property rights are affected, including appropriate permission for material involving children. Do not impersonate someone or falsely claim to speak for a family.

You retain ownership of your submission. By submitting it for a website feature, you give Sol Levinson a nonexclusive, royalty-free permission to store, reproduce, format, display and distribute it as reasonably needed to provide that feature and related memorial services you request. For public memorial contributions, this includes display on the memorial page and in requested memorial-book outputs. Our service providers may process the material on our behalf for those purposes. This is not a transfer of ownership or permission to use your contribution in unrelated advertising.

Formatting may include resizing photographs, adjusting layout and correcting formatting. Material submitted for private review is not made public merely because this permission exists; applicable review and publication controls still apply.

You may ask us to remove a contribution by contacting us and identifying it. Removal requests are subject to verification of authority, applicable law and other people's rights. Permission continues to the extent needed to process the request, maintain lawful records and handle backups. We cannot recall copies already downloaded, printed or shared by others.

Review and moderation

Submissions may be reviewed, withheld or removed when they are inappropriate, infringe rights, compromise privacy or security, violate these terms, or conflict with the intended memorial purpose. Publication is not guaranteed. Automated moderation may approve a memorial message or hold it for staff review; automated review does not guarantee accuracy or suitability.

Do not submit threats, harassment, hateful content, unlawful material, spam, commercial solicitations, malicious files or knowingly false statements. Contact us if you believe a submission has been handled incorrectly.

Public and restricted features

Public memorial messages, names and approved media can be viewed, copied or shared by visitors. Do not include information in public contributions that you intend to remain private. An email address supplied in the separate memorial-book email field is not publicly displayed, but is available to authorized staff and family users as described in the Privacy Policy.

Family access links are intended for the authorized family participants. Keep them private and tell us if a link has been exposed or access should be reviewed. Staff accounts are limited to authorized staff. Do not use another person's account, bypass permissions or access a memorial's private features without authorization.

Email subscriptions, calendars and events

Submit only your own email address or an address you have authority to enroll. Eligible addresses subscribe to daily obituary emails when the signup form is submitted; no confirmation email is required. Previously unsubscribed or suppressed addresses are not automatically reactivated.

Daily obituary emails list newly published obituaries since the previous email, or provide a brief notice on quiet days. They are not a schedule of today's funerals and may include related information or links about our services. Delivery can be affected by technical issues, spam filtering and provider restrictions. Use the unsubscribe link in an email to stop those notifications.

Event registration is separate from obituary email subscription. Review the event's listing and registration communications for availability, access and event-specific instructions. Contact us if you need to change a registration.

A memorial calendar is based on the information supplied and the calculation assumptions shown. Confirm religious observance questions with an appropriate adviser, especially when the timing of death relative to sunset is unknown. Anyone with a saved calendar feed link may access that feed; share it only as intended.

Outside services and links

The website may link to or embed maps, reviews, videos, webcasts, scheduling, planning forms, job applications, charities and partner services. Outside services are subject to their own terms and privacy notices. We do not control their availability, content or independent handling of information. A link does not by itself make the outside provider our agent or make us a party to a transaction you enter into with that provider.

Security and acceptable use

Do not interfere with website operation, distribute malicious code, attempt unauthorized access, circumvent security or access restrictions, or collect private information about users. Do not use automated requests that materially burden the website or bypass access controls. These restrictions do not limit activities that applicable law expressly permits despite a contractual restriction.

We may restrict a feature or access when reasonably necessary to protect the website, respond to suspected misuse or comply with law. Restricting website access does not cancel your rights under a separate funeral-services agreement or applicable law.

Availability, disclaimers and limits

We seek to provide useful, accurate information, but the website may contain errors, interruptions or outdated information. To the extent permitted by applicable law, the website is provided "as is" and "as available," without implied warranties of merchantability, fitness for a particular purpose or noninfringement. We do not promise uninterrupted availability or that every third-party submission, external service or technical transmission will be accurate or secure.

To the extent permitted by applicable law, Sol Levinson & Bros., Inc. will not be liable for indirect, incidental, special or consequential loss arising from use of, or inability to use, the website. This limitation concerns the website, not duties under a separate funeral-services agreement.

Nothing in these terms excludes liability for fraud, willful misconduct, gross negligence or any liability that cannot lawfully be excluded, or limits nonwaivable consumer or privacy rights. If a limitation is not permitted in your circumstances, it does not apply to that extent.

Content and copyright concerns

If you believe material on the website infringes your rights, invades privacy or is materially inaccurate, contact us with the page address, a description of the concern, your relationship to the material and a way to reach you. Please do not send unnecessary sensitive personal documents.

The contact below is a general website contact, not a representation that a statutory copyright agent has been registered. We may request information needed to evaluate a concern and may remove or restrict disputed material while reviewing it.

Changes and interpretation

We may revise these terms to reflect changes to the website or legal requirements. Updated terms will identify their effective date. Material changes requiring notice or renewed agreement will be handled as required by applicable law; posting revised terms does not by itself supply consent where express consent is required.

If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law. These terms do not require arbitration, waive class proceedings or select an exclusive court or governing law. Applicable law determines those matters unless a separate valid agreement provides otherwise.
